Kidnapping Sentences in Minnesota
The sentences in a kidnapping case will depend on whether the victim was released in a safe place without great bodily harm. If so, the maximum sentence can be up to 20 years in jail and/or a fine of $35,000. If, however, the victim was not released in a safe place, suffered great bodily harm, or was a child, then the maximum sentence is 40 years in jail and/or a fine of $50,000.
False Imprisonment in Minnesota
False imprisonment is defined as the intentional confining or restraining of any other person without the person's consent while knowingly lacking lawful authority to do so. It includes confining or restraining someone else's child without consent of the child's parents. False imprisonment is a felony with a maximum sentence of three years in prison and/or a fine of $5,000.
False imprisonment also includes the unreasonable physical confinement or restraint of any child by means including but not limited to tying, locking, caging, or chaining for a prolonged period of time and in a cruel manner which is excessive under the circumstances. This crime is a gross misdemeanor, unless the child suffers substantial bodily harm in which case it is a felony.
