Terroristic Threats in Minnesota
The crime of terroristic threats in Minnesota is divided into three categories:
- Threatened Violence - a direct or indirect threat to commit a crime of violence with the purpose to terrorize another or to cause evacuation of a building in a reckless disregard of the risk of causing such terror. Felony with a sentence up to five years in prison and/or a $10,000 fine;
- Bomb threat – Communicating, with the purpose to terrorize in reckless disregard of the risk of causing such terror, that explosives are present at a named location, whether true or not. Felony with a sentence up to three years in prison and/or a $3,000 fine;
- Showing a Fake Gun – Displaying any replica or toy version of a dangerous weapon that reasonably appears to be a pistol, revolver, shotgun, sawed-off shotgun, rifle, machine gun, or any other firearm, in a threatening matter that causes terror in the other person. Felony with a sentence up to a year and a day in jail and/or a $3,000 fine.
Acts in Furtherance of Terrorism Minnesota
For purposes of this statute, any premeditated felony involving violence to persons or property that is intended to terrorize or intimidate a considerable number of members of the public in addition to the direct victims of the act, and that significantly disrupts the lawful exercise of government, commerce, or the right of lawful assembly, is considered an act in furtherance of terrorism and is subject to a 50% increase in the maximum sentence.
