Minnesota Misdemeanors

Misdemeanors are crimes which could potentially involve a fine as high as $1,000 and/or 90 days in jail. While misdemeanors are the least serious of the crimes in the State of Minnesota, they can nevertheless be very serious, especially with respect to collateral consequences. We have represented numerous people in misdemeanor proceedings. Do not make the mistake of pleading guilty without understanding what that plea will mean for you. A simple misdemeanor assault conviction can negatively impact your employability, especially in careers that place you in contact with patients or other positions of trust.

Common Misdemeanor Charges

Some of the more common misdemeanors are:

  • Serious traffic violations (for example, reckless or careless driving);
  • Driving after Revocation;
  • Driving While Impaired (DWI)
  • Violation of an Order for Protection;
  • Low value theft;
  • Assault;
  • Domestic Assault; etc.

It is worth noting that several violations of the same misdemeanor statute will often convert the offense to a gross misdemeanor or even a felony. For example, a second DWI within 10 years is a gross misdemeanor and a fourth within 10 years is a felony.

Misdemeanor Fines

The fines for misdemeanor offenses are based on the severity of the crime and the circumstances of it. Though the Court can impose the maximum allowed by law of $1,000, misdemeanor fines are usually around $300-$400 plus $82-$85 in surcharges. Probation is often part of the sentencing on misdemeanor cases and can last up to two years in some situations. There are additional fees to be paid to the probation office and to attend classes and treatment as may be ordered at sentencing.
